MyIncident – Privacy Policy

MyIncident (“MyIncident”, “we”, “us”, or “our”) respects your privacy. This Privacy Policy explains how we collect, use, store, and protect information when you use the MyIncident mobile application (“the App”). By using the App, you consent to the practices described in this Policy.

MyIncident is operated from Australia and complies with the Australian Privacy Act 1988 (Cth).

1. Overview

MyIncident is a user‑controlled personal documentation tool.
We collect only the information necessary to provide the App’s core functionality.

We do not:

  • sell user data
  • use advertising trackers
  • build behavioural profiles
  • access your content unless technically required to operate the service or required by law

You control the content you create.

2. Information You Provide

a. User‑Generated Records

When you create a record, you may choose to include:

  • text notes
  • photos
  • audio or video (if enabled)
  • optional location data (if you allow it)

All content is created solely at your initiative.
You are responsible for ensuring you have the legal right to record or upload any content.

b. Account Information (if applicable)

If the App supports accounts, we may collect:

  • email address
  • basic identifiers
  • authentication details

This information is used only to provide access, support, and account‑related functionality.

3. Automatically Collected Information

We may collect limited technical information, such as:

  • device type and operating system
  • app version
  • crash logs and diagnostics
  • performance data

This information is used only to maintain, secure, and improve the App.

We do not collect advertising identifiers.

4. Device Permissions

The App requests access to device features only when required for features you choose to use:

  • Camera / Microphone – to capture content you initiate
  • Location – only if you explicitly enable location tagging
  • Storage / Photos – to save or export records

Permissions can be managed or revoked at any time through your device settings.

5. How We Use Information

We use information to:

  • allow you to create, view, and manage records
  • enable exports you request
  • provide customer support
  • maintain performance, security, and reliability
  • improve the App

We do not use your data for advertising, profiling, or behavioural tracking.

MyIncident does not access, review, or monitor incident content except where:

  • technically necessary to operate the service
  • required to investigate misuse
  • required by law

6. Third‑Party Service Providers

We may use trusted third‑party service providers to support App functionality, including:

  • cloud hosting
  • analytics
  • crash reporting
  • email support tools

These providers may process data on our behalf but are not permitted to use it for their own purposes.

7. Data Storage and Security

User data is stored using industry‑standard security measures.

While we take reasonable steps to protect information, no system is completely secure.
You use the App at your own risk.

Data may be stored or processed on secure cloud infrastructure located in Australia, the United States, or other jurisdictions.

8. Data Retention

We retain information only for as long as necessary to provide the App’s functionality.

You are responsible for exporting or retaining copies of your records if you wish to preserve them outside the App.

Some technical logs may be retained for security, troubleshooting, or legal compliance.

9. Data Sharing

We do not sell, rent, or trade user data.

We may share information only:

  • with service providers acting on our behalf
  • if required by law, court order, or lawful request from authorities
  • to investigate misuse or security incidents

We do not share user‑generated content unless legally compelled.

10. User Control and Deletion

You may:

  • delete records within the App
  • revoke permissions at any time
  • request account deletion (if applicable)

To request deletion, contact: support@myincident.com.au

Deleting the App does not automatically delete stored data.
Some residual technical logs may remain for legal or security purposes.

11. Children’s Privacy

MyIncident is not intended for children under 13.
We do not knowingly collect personal information from children.

If you believe a child has provided information, contact us so we can delete it.

12. International Users

Your information may be stored or processed in countries other than your own.
By using the App, you consent to this processing.

13. Export Disclaimer

Acceptance of exported reports is determined by third parties and applicable law.
MyIncident makes no guarantees regarding admissibility, evidentiary value, or acceptance by employers, insurers, courts, or authorities.

14. Changes to This Policy

We may update this Privacy Policy from time to time.
Continued use of the App after changes take effect constitutes acceptance of the updated Policy.

These Terms and Conditions (“Terms”) govern your use of the MyIncident mobile application (“MyIncident”, “the App”, “we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Purpose of the App

MyIncident is a personal documentation tool that allows users to create time‑stamped, user‑generated records of incidents or events for personal documentation and reference.

The App:

  • does not verify the accuracy of user content
  • does not certify, validate, or authenticate events
  • does not provide legal, medical, law‑enforcement, or professional advice

All records are created solely at the initiative of the user.

2. User‑Generated Content

You are solely responsible for:

  • the content you record
  • the accuracy, completeness, and truthfulness of that content
  • how you choose to use, share, or export it

MyIncident does not review, edit, endorse, or verify user records.

We make no representations about how records may be interpreted, accepted, or relied upon by third parties.

You must ensure you have the legal right to record or upload any content you create.

3. No Legal, Professional, or Official Authority

MyIncident:

  • is not a law enforcement service
  • is not an official reporting system
  • is not a medical or emergency service

Use of the App does not create:

  • an official report
  • a verified record
  • a legally binding document

If you require legal, medical, emergency, or professional assistance, you must contact the appropriate authority or qualified professional.

MyIncident does not replace employer reporting systems, workplace safety obligations, or compliance requirements.

4. User Control & Consent

All records are created only when you actively choose to do so.

The App does not:

  • monitor you
  • record automatically
  • collect content without your action

Permissions (camera, microphone, location, storage) are requested only to support features you explicitly use. You may manage or revoke permissions at any time through your device settings.

5. Storage and Access

Records are stored in accordance with our Privacy Policy.

We do not guarantee:

  • indefinite storage
  • permanent availability
  • suitability for any external or official use

Digital data may be lost, corrupted, or inaccessible. MyIncident is not responsible for lost records.

You are responsible for exporting or retaining copies of your records if you wish to preserve them outside the App.

6. Paid Features & In‑App Purchases

Some features, including exporting records, may require a one‑time or recurring in‑app purchase.

All purchases:

  • are processed through Apple’s In‑App Purchase system
  • are subject to Apple’s terms and refund policies
  • are clearly presented before purchase

Prices and availability may change at any time.

7. External Data, Insights & Recommendations

Any insights, summaries, or outputs generated by the App are for informational purposes only and should not be relied upon as professional, operational, legal, or strategic advice.

The App may incorporate third‑party data sources. We do not guarantee the accuracy, completeness, or reliability of any external data.

8. Third‑Party Service Providers

The App may use third‑party service providers (such as cloud hosting, analytics, crash reporting, and email support tools) to support functionality.

These providers may process data on our behalf but are not permitted to use it for their own purposes.

9. Acceptable Use

You agree not to use MyIncident to:

  • create false or misleading records
  • impersonate individuals or organisations
  • harass, threaten, or harm others
  • violate any laws or regulations
  • upload unlawful or defamatory content
  • record where prohibited by law
  • infringe privacy or confidentiality rights

We may restrict or terminate access if misuse is suspected.

10. Intellectual Property

All rights in the App, including design, software, trademarks, and branding, belong to MyIncident or its licensors.

You retain ownership of your own content.

You may not copy, modify, distribute, or reverse‑engineer the App except as permitted by law.

11. Disclaimer of Warranties

The App is provided “as is” and “as available”.

We do not warrant that:

  • the App will meet your specific needs
  • records will be accepted or relied upon by any third party
  • the App will be uninterrupted, secure, or error‑free

Use of the App is at your own risk.

Exported records are user‑generated documents created from user‑provided information and system metadata. MyIncident does not certify or guarantee their acceptance by any third party.

12. Limitation of Liability

To the maximum extent permitted by law, MyIncident is not liable for:

  • indirect, incidental, or consequential losses
  • decisions made based on user‑generated records
  • loss of data or inability to access records
  • reliance on exported documents

Our total liability is limited to the greater of:

  • the amount you paid for the App in the last 12 months, or
  • AUD $100.00

13. Law Enforcement & Legal Requests

We may disclose information if required by law, court order, or lawful request from authorities.

14. Termination

You may stop using the App at any time.

We may suspend or terminate access if required by law, if these Terms are materially breached, or if misuse is suspected.

15. User Eligibility

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the App.
If you are under 18, you must have permission from a parent or guardian.

16. Governing Law

These Terms are governed by the laws of Western Australia.
You agree to submit to the exclusive jurisdiction of the courts of Western Australia.

17. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyIncident regarding use of the App.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
